Solarius Energy Inc. (“Solarius”, “we”, “us”, “our”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what we collect through this website and our advertising, why we collect it, who we share it with, and the rights you have under Republic Act No. 10173, the Data Privacy Act of 2012 (“DPA”), its Implementing Rules and Regulations, and the issuances of the National Privacy Commission (“NPC”).

By using this website or submitting an enquiry to us, you confirm that you have read and understood this Policy.

1. Who we are

Solarius Energy Inc. is a solar energy solutions provider established in February 2017, supplying and installing grid-tied, hybrid and off-grid solar systems and battery storage for residential, commercial and industrial customers across Luzon.

This Policy covers www.solarius.com.ph and the enquiry, quotation and lead forms we operate on it or through advertising platforms. Our electric vehicle charging platform is operated by a related entity under its own terms; see section 14.

2. The personal information we collect

Information you give us. When you complete a quotation request, contact form, callback request or lead form, or when you email, call or message us, we may collect:

• your name;
• your email address and mobile or landline number;
• your address, city, province or postal code, and the location of the property to be assessed;
• your average monthly electricity bill or consumption;
• details of your property, roof, or existing electrical installation that you choose to share;
• the content of your enquiry and any subsequent correspondence with us.

Information collected automatically. When you browse the website, we and our analytics and advertising providers may collect:

• your IP address, approximate location derived from it, browser type, device type and
• operating system;
• the pages you view, the time and duration of your visit, and the links you click;
• the website, search or advertisement that referred you to us;
• advertising click identifiers passed in the link you arrived from, and identifiers stored in cookies set by advertising platforms, which allow an enquiry to be matched back to the advertisement that produced it.

Information from advertising platforms. If you submit your details through a lead form displayed inside Google or Meta (Facebook and Instagram) rather than on our website, that platform collects your details and transmits them to us. Their own privacy policies govern how they handle your information before it reaches us. We do not ask for and do not want sensitive personal information as defined in the DPA — such as government identifiers, health information or financial account numbers — through this website. Please do not submit it through our web forms.

3. How we use your personal information

We use your personal information to:

• respond to your enquiry and answer your questions;
• arrange and carry out a site assessment and prepare a quotation or system design;
• supply, deliver, install, commission and service the system you purchase, including through our installation teams and subcontractors;
• provide after-sales support, warranty service and maintenance;
• process payments and administer our contract with you;
• send you information about our products, promotions and events where you have agreed to receive it, or where you are an existing customer and the information is related to what we supplied you — you may opt out at any time;
• measure and improve the performance of our advertising, including reporting back to advertising platforms that an enquiry or sale resulted from a particular advertisement;
• understand how the website is used, and improve its content and functionality;
• keep records required for accounting, tax, warranty and regulatory purposes, and to establish, exercise or defend legal claims;
• comply with applicable law and lawful requests from regulators and authorities.

4. Our lawful basis for processing

Depending on the purpose, we rely on one or more of the criteria for lawful processing under sections 12 and 13 of the DPA:

• Your consent — for marketing communications and for non-essential cookies and advertising technologies;
• The performance of a contract with you, or steps taken at your request before entering into one — for quotations, site assessments, supply and installation;
• Compliance with a legal obligation — for tax, accounting and regulatory record-keeping;
• Our legitimate interests — for measuring advertising performance, securing and improving the website, and protecting our business, where those interests are not overridden by your rights and freedoms.

5. Cookies and similar technologies

Cookies are small files placed on your device. This website uses them for the following
purposes.

Most browsers let you see which cookies are set, delete them individually or block them altogether, through the browser’s settings. Blocking cookies may stop parts of the website, including our enquiry forms, from working as intended. You can also control advertising-related processing directly with the platforms: Google’s ad settings at myadcenter.google.com and its opt-out tools at tools.google.com/dlpage/gaoptout, and Meta’s ad preferences within your Facebook or Instagram account settings.

6. Who we share your information with

We do not sell your personal information, and we do not share it for anyone else’s independent marketing.

We share it only where necessary, with:

• Our employees, installation teams, engineers and subcontractors, so they can assess your site and carry out your installation;
• Service providers who process information on our behalf, under contract and on our instructions — our web hosting provider, our customer relationship management platform (ClickUp), our email and productivity providers, and our marketing agency;
• Advertising and analytics platforms (Google and Meta), which receive website activity and, where an enquiry results from an advertisement, confirmation of that outcome, so that campaign performance can be measured;
• Professional advisers, such as our accountants and lawyers, where needed;
• Financing, insurance or warranty partners, only where you ask us to arrange such an option for you;
• Government agencies, regulators, courts or law enforcement, where we are required or permitted by law to do so, or where it is necessary to protect our rights or the safety of any person;
• An acquirer, in connection with a sale, merger or reorganisation of our business, subject to the protections in this Policy.

7. Transfers outside the Philippines

Some of the providers above store and process information on servers located outside the Philippines. Where that happens, we remain accountable for your information and take steps to ensure it receives a comparable level of protection, through contractual commitments with those providers, as required by the DPA.

8. How long we keep your information

We keep personal information only for as long as it is needed for the purpose it was collected for:

• Enquiries that do not proceed: up to two (2) years from your last contact with us, so we can respond if you come back to us;
• Customer and installation records: for the duration of your warranty and for a further five (5) years after it ends, to support warranty and after-sales claims;
• Accounting and tax records: ten (10) years, in line with Philippine tax requirements;
• Website analytics and advertising data: as governed by the retention settings of the relevant platform, typically no more than fourteen (14) months at event level.

When information is no longer needed, we securely delete or anonymise it.

9. How we protect your information

We apply organisational, physical and technical measures to protect personal information against loss, misuse and unauthorised access, including encrypted connections to this website, access controls limiting who in our organisation can see enquiry data, and contractual security obligations on our service providers. No system is completely secure, so we cannot guarantee absolute security, but we take these obligations seriously and review them regularly.

10. Your rights

Under the Data Privacy Act you have the right to:

• be informed whether your personal information is being processed, and for what purpose;
• access the personal information we hold about you;
• object to processing, including direct marketing and profiling, and to withdraw a consent you previously gave;
• rectify information that is inaccurate or out of date;
• erasure or blocking of information that is incomplete, outdated, false, unlawfully obtained or no longer necessary;
• data portability — to obtain a copy of information you gave us in a commonly used electronic format;
• damages for inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorised use of your personal information;
• lodge a complaint with the National Privacy Commission.

To exercise any of these rights, contact us using the details in section 15. We will respond within
the period required by the NPC, and we may need to verify your identity before acting on a
request.

11. Marketing and how to opt out

If you no longer wish to hear from us, click the unsubscribe link in any marketing email, reply to any message asking to be removed, or email info@solarius.com.ph. We will act on the request promptly. We will still contact you where necessary about a quotation, installation or warranty matter that is already underway.

12. Children

This website and our services are directed at adults. We do not knowingly collect personal information from anyone under 18 years of age. If you believe a minor has given us their information, contact us and we will delete it.

13. Links to other websites

Our website and our advertising may link to websites we do not operate. We are not responsible for their content or their privacy practices, and we encourage you to read the privacy policy of any site you visit.

14. Our EV charging platform

Our electric vehicle charging service is operated by Solarius EV Charging Inc. under its own Terms and Conditions, available on this website. If you use that platform, its terms and the privacy notice provided within it apply to that service in addition to this Policy.

15. Changes to this Policy

We may update this Policy from time to time to reflect changes in our practices or in the law.
The date at the top of this page shows when it was last revised. Material changes will be announced on this page.
